Terms and Conditions of Sale
CakeSmiles.com Ltd of 27 French Road, Leicester, LE5 4AH is referred to below as "CakeSmiles".
CakeSmiles reserve the right to change these Terms and Conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions. Ordering
When you place an order via this website you will be sent an auto-generated Order Acknowledgement by email detailing everything you have ordered. This email is not an order confirmation or order acceptance from CakeSmiles. Acceptance of your order and the completion of the contract between you and CakeSmiles will take place on dispatch to you of the products ordered unless CakeSmiles notifies you that your order has not been accepted or you have cancelled it.
It is your responsibility to check the address details you have supplied are accurate and complete, since no refunds are given on goods delivered to the wrong address due to an error on your part.
Prices
All retail prices on this site are in British Pounds Sterling (£GBP). Cakes do not incur Value Added Tax (VAT) but candles purchased on their own will incur Value Added Tax (VAT) at 17.5% which will be added to the overall checkout total (including postage). By default, any candles purchased with a cake, will have the packaging removed and the candles will be put on the cake for you. Any candles and cake toppers purchased on their own, will be left in their respective packaging, and will be posted/collected in the same state.
Order Processing
We aim to process and dispatch orders within 2-3 business days, although just before and after public holidays it may be 3 days due to increased demand. Orders are accepted at the sole discretion of CakeSmiles and are subject to your credit or debit card being authorised for the transaction. All transactions are conducted through a secure web server (see the Website statement/Site Security page for more information).
Shipping & Handling Charges
Prices do not include the cost of delivery to your door. You can view the final total including delivery costs at the checkout stage prior to confirming your order.
Deliveries
We deliver throughout the UK and we aim to deliver all orders within a 2 hour time slot. We will not be liable for orders delivered late due to circumstances beyond our control. Late deliveries may be reimbursed at the discretion of CakeSmiles.
Damages and Errors
Check your order carefully upon delivery and report any signs of damage before signing for receipt of goods. All damages incurred during transit must be reported immediately to CakeSmiles by email and also the Carrier Company or Royal Mail. Do not throw away the carton or any packaging materials since the Carrier Company or Royal Mail will need to inspect them before paying compensation.
Any errors must be reported to CakeSmiles immediately by email or phone.
Returns & Refunds
CakeSmiles want you to be completely happy with your purchase. Foodstuffs should be checked at time of sale. Any mistakes or changes should be made clear as once purchased, no refund is available.
Reimbursements in relation to product quality are at the discretion of CakeSmiles. Any faulty accessories (candles and cake toppers) can be returned to us, where we can provide the same item, similar item or a refund. After cake toppers are checked at the time of sale, no refund is then available.
Unless agreed and arranged in advance, CakeSmiles are not liable for any costs incurred in returning items to us.
Order Cancellation
Should you wish to cancel your order we need to receive notice by telephone or email. For cancelled orders the deposit will not be refunded. Cake orders cannot be cancelled less than 2 days prior to the order delivery date.
Use of this site
Every effort is taken to ensure that the information contained in this website is correct and up-to-date. However, CakeSmiles disclaim all warranties and representations as to the accuracy of any information contained if at any time it becomes inadvertently out-of-date or incomplete. CakeSmiles cannot be held responsible for any loss or damage that may arise from the use of this information.
CakeSmiles are not responsible for this site's accuracy or the reliability of the access to this site. Neither will we assume responsibility for the content of any other website to which this site links to. These links are provided for your convenience only.
These conditions are governed and construed by English law. English courts will resolve any disputes. These Terms and Conditions do not affect your statutory rights as a customer.
